MEMORANDUM OPINION AND ORDER signed by JUDGE LORETTA C. BIGGS on 6/22/2015. ORDERED that Defendants' [Joint] Rule 21 Motion to Dismiss Williams as a Nominal Party (ECF No. 14 ) is DENIED. FURTHER that Plaintiff's Motion to Remand and for Costs and Attorneys' Fees (ECF No. 17 ) is GRANTED IN PART to the extent that the matter is hereby REMANDED to the General Court of Justice, Superior Court Division, Forsyth County, North Carolina, and DENIED IN PART with respect to Plainti ff's request for attorneys' fees and costs. FURTHER that Defendant Janet Williams' Rule 12(b)(6) Motion to Dismiss (ECF No. 10 ) and Defendant State Farm's Rule 12(b)(6) Motion to Dismiss (ECF No. 12 ) are DENIED AS MOOT in light of the remand. The Clerk of Court is DIRECTED to send a certified copy of this Order to the Forsyth County, North Carolina, Clerk of Superior Court and to effect the remand. (Butler, Carol)
