MEMORANDUM OPINION AND ORDER signed by JUDGE WILLIAM L. OSTEEN, JR on 3/25/2019; that Defendant Duke University's motion to dismiss, (Doc. 29 ), is GRANTED. FURTHER that Defendant Sheila Broderick's motion to dismiss, (Doc. 26 ), is GRANTED IN PART AND DENIED IN PART as set forth herein, in that the motion is GRANTED as to Plaintiff's claims for violation of N.C. Gen. Stat. § 99D1 et seq., violation of N.C. Gen. Stat. § 75 -1 et seq., negligent infliction of emotional distress, and negligence, and DENIED as to Plaintiff's claim for intentional infliction of emotional distress. FURTHER that Defendant Steven Thomas Bishop's motion to dismiss, (Doc . 31 ), is GRANTED IN PART AND DENIED IN PART as set forth herein, in that the motion is GRANTED as to Plaintiff's claims for violation of N.C. Gen. Stat. § 99D1 et seq., negligent infliction of emotional distress, and negligence, and DENIED as to Plaintiff's claim for intentional infliction of emotional distress. (Sheets, Jamie)
