ORDER granting in part and denying in part Defts' 24 , 26 & 31 Motions to Dismiss the Amended Complaint. Specifically, granting Defts' Motions to extent (1) Pltf's Fifth Claim for Relief for fraudulent indu cement is dismissed with prejudice as to all Defts, and (2) Pltf's Sixth Claim for Relief for unfair and deceptive trade practices is dismissed with prejudice as to Defts Peter Pinholster and Paul Pinholster, and denying Defts' Motions to Dismiss in all other respects.
