Filing 63 Memorandum Opinion and Order: Having considered the parties' arguments in their various filings, the Court concludes that there are no material factual disputes that would preclude summary judgment. Defendant Ford is entitled to summary j udgment on plaintiffs' claim of employer intentional tort. Since Mrs. Rudisill's lack of consortium claim is derivative of the intentional tort claim, that claim must also fail. Accordingly, Doc. No. 30 Defendant's Motion for summary judgment is GRANTED. Judge Sara Lioi on 03/30/2012. (H,KR) |
