Filing 149 Memorandum Opinion and Order In light of the most recent Memorandum of Opinion and Order issued by the Court (ECF Nos. 137 ; 138 ; 139 ), it appears as though the case against Miller has become somewhat threadbare. The Court, therefore, is inclined to approve the dismissal. However, the Court will not eschew proper procedure in doing so. The Court will expect the Fund to file a brief indicating it has contacted the other plaintiffs in this matter. The Fund will further inform the Court as to the proper procedure for approving such dismissal, citing to appropriate Federal Rules of Civil Procedure and applicable case law. In the future, the Fund will be expected to state with clarity in the body of a document filed with the Court whether it is purporting to act on its own, or as Lead Plaintiff. Judge Benita Y. Pearson on 10/15/2012. See Order for details. Related Doc. No. 147 .(S,L) |
Filing 139 Memorandum Opinion and Order For the reasons stated, the motions to dismiss filed by Defendants Miller, Geswein, Krakora and Diebold, ECF Nos. 94 ; 95 ; 96 ; 97 , are dismissed as moot or duplicative. Judge Benita Y. Pearson on 8/31/2012. (S,L) |
Filing 109 Memorandum Opinion and Order The Court denies Defendant Sandra Miller's motion to stay discovery in the State shareholder derivative action as moot (ECF No. 67 ); and grants Defendants Kevin Krakora, Gregory Geswein, and Diebold's motions to the extent they regard striking Plaintiff's allegations preceding June 30, 2005 (ECF Nos. 93 ; 95 ; 97 ). Judge Benita Y. Pearson on 2/14/2012. (S,L) |
