Opinion and Order granting in part 36 Defendants All Metal Sales, Inc. and Thomas G. Klocker's Motion to Dismiss and for Attorneys' Fees. Because the Court does not find res judicata bars Plaintiff's claims, the Court dismis ses both claims in the Complaint for failure to state a claim, without prejudice.
