Opinion and Order The Court GRANTS IN PART the Motion to Dismiss (Doc #: 26 ) as follows. The Court dismisses with prejudice the federal Declaratory Judgment Act claim alleged in Count II, the claim for breach of implied warranty of fitness for a particular purpose alleged in Counts VI and VII, and the claim for breach of the implied warranty of merchantability alleged in Count IV on behalf of Plaintiffs residing in the State of Washington. The Court dismisses without prejudice the c laim for breach of the implied warranty of merchantability alleged in Count IV on behalf of Plaintiffs residing in the States of California, Ohio and New York.
