Memorandum Opinion and Order Remanding Action to State Court. The Whites' Motion to Remand 10 is granted. While Sandru, a nominal Defendant, need not consent to removal of this action, this Court declines to exercise its discretionary declaratory judgment jurisdiction. Under the circumstances of this case, removal was not objectively unreasonable. Therefore, the Whites' Motion for Fees and Costs 10 is denied. Judge Jack Zouhary on 9/26/2014. (D,L)
