Order: Defendants' joint motion for summary judgment be, and the samehereby is, granted, except with regard to plaintiffs § 1983 Fourth Amendment claim for unreasonable use of force and his state law claim for assault and battery, as to which claims the motion is denied. The Clerk shall forthwith set a status/scheduling conference. In light of my comments in footnote 3, the Clerk shall cause a copy of this order to be served on Ms. Julia Bates, Lucas County Prosecutor, in addition to service on counsel of record. Judge James G.
