Filing 88 Memorandum Opinion and Order. For all the reasons stated within this Order, BGRS's Motion to Dismiss the Burnleys' Amended Counterclaims is GRANTED. (BGRS's Mot. to Dismiss Burnleys' Am. Countercls., ECF No. 49 .) The Bur nleys' claims of defamation and "emotional distress" are dismissed. The Burnleys' Motion to Amend their Counterclaims for a second time is DENIED as any further amendment would be futile - the Burnleys fail to state legally cogn izable claims for intentional infliction of emotional distress, negligent infliction of emotional distress, or abuse of process. (Burnleys' Mot. to Am. Countercls., ECF No. 68 .) Given this disposition, no claims or issues remain between the parties. Therefore, this matter is hereby DISMISSED in its entirety, with prejudice.
