Petitioner shall be released from custody unless th e State of Oregon elects to retry her within 90 days of the date of this Opinion and Order. A certificate of appealability is issued as to all grounds for relief on the basis that petitioner has made a substantial showing of the denial of a constitutional right. See 28 U.S.C. § 2253(c)(2).
