June 12, 2014 Opinion or Order Filing 360 ORDER: The Court GRANTS AFD Chinas Motion 344 as to the declaratory judgment that AFD China seeks and AWARDS AFD China $1.00 in nominal damages on its Unfair Competition Claim. The Court DENIES the remainder of AFD Chinas Motion [344 ] as to injunctive relief. The Court also DENIES as premature AFD Chinas Motion 345 for Entry of Judgment on Alter Ego. The Court directs the parties to confer concerning a form of judgment consistent with this Opinion and Order and the other disp ositive decisions in the record. The parties shall submit no later than June 27, 2014, a single jointly proposed form of judgment. To the extent that the parties disagree as to the form of judgment, they each shall file (in addition to the single proposed form, which may include alternative provisions) a memorandum not to exceed five pages explaining the legal bases for any disputed proposals. In the exercise of its discretion and in the absence of more reliable cost information from either party, the Court concludes the following is a fair allocation of these disputed costs between the parties: AFD Chinas tot al claimed copying expense of $15,309.25 shall be reduced by twenty per cent (20%) to $12,247.40, and AFD China is entitled to reimbursement of one-half of that cost from AFD USA in the amount $6,123.70 less the $2,000 AFD US A already paid to AFD China. The Court orders AFD USA to reimburse AFD China the further sum of $4,123.70 for AFD Chinas costs of producing the documents provided to AFD USA in discovery no later than April 1, 2013.
