A&T's motion 21 for partial summary judgment is granted with regard to Capitols affirmative defenses of another action pending,standing, and real party in interest. A&T's motion 15 to amend is granted. A&T is directed to file the amended complaint within thirty (30) days of the date of this Opinion.
