September 16, 2014 Opinion or Order Filing 261 ORDER: The Court GRANTS Plaintiffs Motion 257 for Attorney Fees and AWARDS to Plaintiff attorneys' fees in the amount of $5,512.50 and expenses in the amount of $5,716.25. Because there are not any other issues for this Co urt to resolve in this case, the Court DISMISSES this matter in its entirety. Accordingly, the Court directs Plaintiffs counsel to confer with Defendants counsel and to submit no later than September 30, 2014, a form of Final Judgment for the Courts consideration. June 23, 2014 Opinion or Order Filing 252 Opinion and Order: The Court DENIES Apantacs Motion for Partial Summary Judgment 188 , GRANTS in part Defendants Motion for Summary Judgment 200 as to Apantac's First and Fourth Claims and DISMISSES without prejudice Apantacs Secon d Claim for Conversion as premature. The Court also DISMISSES Apantacs Third Claim for Slander that Apantac voluntarily withdrew. The Court also ADOPTS in part the Findings and Recommendation (F&R) of the Special Master 244 and SANCTIONS Defendants to pay an AWARD of reasonable attorneys fees and costs to Apantac in amount to be determined at a later date. The Court DECLINES to adopt the remainder of the Special Masters F&R in which he recommends this Court permit further discovery. After de termining the amount of attorneys fees and costs to award to Apantac on its Motion for Sanctions, the Court will DISMISS this matter in its entirety. Unless the parties otherwise settle their differences, the Court directs Apantac to file no later th an July 8, 2014, a motion for its attorneys fees and costs incurred in pursuing discovery as a result of Defendants discovery abuses together with all necessary supporting materials (see Local Rule 54-3). Defendants' response to such Motion (if any) is due July 22, 2014. No reply will be permitted, and the Court will take the issue under advisement on July 22, 2014, without oral argument.
