Filing 55 OPINION AND ORDER: For the reasons stated, I ADOPT the F&R 49 as to Plaintiffs Motion for Summary Judgment 32 and Defendants Motion for Partial Summary Judgment 36 on Mr. Millers negligence claim against the City of Portland. I GRANT su mmary judgment for Defendants on Mr. Millers claim for wrongful arrest under the Fourth Amendment. Plaintiffs Motion for Summary Judgment 32 is DENIED; Defendants Motion for Partial Summary Judgment 36 is GRANTED. Defendants Motion to Withdraw Objections 53 is GRANTED.
