OPINION and ORDER - Based upon the foregoing, Marriott's Motion for Summary Judgment 18 is GRANTED, in part, and DENIED, in part; DuPuis's Motion for Sanctions Re: Spoliation 32 is DENIED; and Marriott's Motion for Leave 45 is DENIE D. IT IS FURTHER ORDERED that within 30 days of the date of this Opinion and Order, counsel for DuPuis will notify the court whether the Estate of Mabel DuPuis will proceed with this litigation.
