Filing 11 OPINION AND ORDER: For the foregoing reasons, Defendants Motion to Dismiss 7 is GRANTED. To the extent that Mr. Sussans § 1983 claim is based on violations of the Eighth and Fourteenth Amendments relating to the eye injury, that claim is dismissed without prejudice. To the extent that the § 1983 claim is based on violations of the Fourth Amendment, or on the denial ofworkers compensation, that claim is dismissed with prejudice.
