March 24, 2014	Filing 38 OPINION and ORDER - This Court follows the recommendation of the Advisory Committee and reviews Judge Acosta's Findings and Recommendation for clear error on the face of the record. No such error is apparent. Accordingly, the Court ADOPT S Judge Acosta's Findings and Recommendation (Dkts. 33 and 36 ). Bernath's motion to dismiss 20 is construed as a notice of voluntary dismissal under Rule 41 and is GRANTED and the case is terminated on that notice.
