Filing 78 OPINION & ORDER: Plaintiffs' motion to dismiss and to amend 61 is granted in part and denied in part as follows: (1) the motion to dismiss the Colorado subclass claim, Beck as a Plaintiff and as the Colorado subclass representative, and Allport as a Plaintiff and as one of the Michigan subclass representatives is granted, and that claim and those Plaintiffs are dismissed without prejudice; (2) the motion to amend is granted as to the proposed clarification of the Oregon subclass cl aims; (3) the motion to amend is otherwise denied.
