Filing 79 ORDER - No party having made objections, this Court follows the recommendation of the Advisory Committee and reviews Judge Beckerman's Findings and Recommendation for clear error on the face of the record. No such error is apparent. Acco rdingly, the Court ADOPTS Judge Beckerman's Findings and Recommendation, Dkt. 76 . The motions to dismiss filed by eBay Inc. and Universal Music Corporation (Dkts. 60 , 63 ) are GRANTED. Additionally, Plaintiff has failed to state a claim aga inst the non-moving defendants Bandmine, Inc. and SnoCap, Inc. Accordingly, this case is DISMISSED in its entirety, against all defendants, with prejudice. The Court further finds that any appeal from this Order would not be taken in good faith and Plaintiff's in forma pauperis status should be revoked pursuant to 28 U.S.C. § 1915(a)(3).Signed 1/6/2016 by Judge Michael H. Simon. (mja) |
