Filing 35 ORDER - The Court ADOPTS Magistrate Judge Acostas Findings & Recommendation 32 . Therefore, for the reasons stated in the record, the Court grants Defendants motion to dismiss 9 without prejudice and denies Defendants motion for a more defi nite statement 9 as moot. If Plaintiff chooses to file an amended complaint, he must do so within 10 days of the date below. In addition, the Court orders Plaintiff to remedy any defects in service of process if he files an amended complaint and to file proof of service with the Court within 30 days of filing an amended complaint.
