IF PETITIONERS NEW TRIAL DOES NOT COMMENCE WITHIN THE TIME SPECIFIED, THE WRIT SHALL ISSUE, AND THE COMMONWEALTH SHALL VACATE PETITIONERS CONVICTION ON THE FIRS T DEGREE MURDER CHARGE.
