MEMORANDUM (Order to follow as separate docket entry) For the reasons discussed above, Defendants Motion to Dismiss (Doc. 5) is granted. Count Three for Good Faith and Fair Dealing, Count Four for Breach of Fiduciary Duty, Count Six for Unfair Trade Practices and Consumer Protection Law (UTPCPL), Count Seven for Negligence, and Count Eight for Vicarious Liability are dismissed. The UTPCPL claim (Count Six) is dismissed without prejudice; Counts Three, Four, Seven and Eight are dismissed with prejudice. Counts One, Two and Five go forward in their entirety.
