OPINION AND ORDER that Defendant DOC's Motion to Dismiss 10 is GRANTED, and Plaintiff's claims against said Defendant are dismissed. In addition, pursuant to the authority granted this Court by the PLRA, Plaintiff's claims against D efendant Erie County Executive/Council are hereby dismissed for Plaintiff's failure to serve said Defendant within 120 days of the filing of his complaint, as required by Rule 4(m) of the Federal Rules of Civil Procedure.
