Filing 60 MEMORANDUM AND OPINION - DENYING 43 Renewed MOTION for Partial Summary Judgment on Liability and Factual Cause filed by LEVONE BUTTS, 46 Renewed MOTION for Partial Summary Judgment Corrected Version filed by LEVONE BUTTS, and GRANTI NG 39 MOTION for Summary Judgment filed by GEORGIA WEISZ, LLOYD WEISZ. As set forth more fully in the memorandum opinion, plaintiff did not adduce sufficient evidence with respect to causation, which is a necessary element of her negligence claim against defendants. By reason of the lack of existence of genuine issues of material fact with respect to the causation element, partial summary judgment cannot be granted in favor of plaintiff, and summary judgment must be granted in favor of defendants. Signed by Judge Joy Flowers Conti on 2/25/2010. (bjk) |
