The remainder of the Motions are DENIED, as stated in the body of the accompanying Opinion, without prejudice. If Defendant wishes to file an additional Motion for Summary J udgment, consistent with the accompanying Opinion, it may do so within fifteen (15) days from the date of this Order. Plaintiff may respond within fifteen (15) days thereafter. When the issue of employer status is resolved, the Court will revisit the issue of whether a violation occurred, if necessary.
