MEMORANDUM OPINION indicating that, for reasons stated more fully within, the motion to dismiss filed Defendants Beard, Capozza, Coleman, Cristini, Davis, Folino, Geehring, Harry, Jackson, Mark, Brenda Martin, Jeffrey Martin, McCombie, Muhammad, Nick olas, Reisinger, Scott, Smith, Swartz, Tanner, Watson, and Winfield (Moving Defendants) (ECF No. 50 ) will be granted with prejudice in part, granted without prejudice in part, and denied in part. Additionally, Defendants Cowan, Workman, LeMasters, Price, Gent, John/Jane Does mail inspectors #1-5, Menchyk, Rogers, Pollock, Walker, Lindley, Grainey, Macknair, Perez, Valdo, Dietz, and the Bureau of Treatment Services (New Defendants) will be dismissed for failure to prosecute.
