The Motion for Summary Judgment filed by Defendants is GRANTED as to all federal claims alleged in Plaintiffs Compl aint. The Pennsylvania pendent state law claims against Abel in his individual capacity for assault and battery are DISMISSED without prejudice forthwith; and the Pennsylvania pendent state law counterclaims against Plaintiff for assault and battery are DISMISSED without prejudice forthwith.
