Filing 54 MEMORANDUM OPINION indicating that, for reasons stated more fully within, the Court finds that Defendants are not subject to personal jurisdiction in Pennsylvania. However, because the action could have originally been brought in the Western Distric t of North Carolina and because a transfer is in the interest of justice, the action will be transferred to that district, rather than dismissed, pursuant to 28 U.S.C. § 1631. An appropriate Order follows. Signed by Judge Nora Barry Fischer on 4/11/11. (jg) |
Filing 28 MEMORANDUM OPINION indicating that, for the reasons more fully stated in said Opinion, Defendant Yates' Motion to Dismiss Amended Complaint for Lack of Personal Jurisdiction, Improper Venue and Failure to State a Claim 21 and Defendant Quickel 's Motion to Dismiss Amended Complaint Pursuant to Fed.
