Filing 46 MEMORANDUM OPINION: On June 17, 2010, the court heard oral argument and made various rulings on the record with respect to the issues presented in the supplemental briefing. This opinion addresses the courts ruling with respect to defendants motion to dismiss the claim plaintiffs assert pursuant to the Lanham Act. This court concludes that it would be inappropriate to ignore the main thrust of plaintiffs allegations that Aquatech passed off Sidems trade secret information as its own, and under those circumstances Dastar bars plaintiffs Lanham Act claim asserted under § 43(a)(1)(B).
