MEMORANDUM OPINION, indicating that, for the reasons stated more fully within, the Court concludes that the Bankruptcy Court did not err when it found that: the sale of property to Appellants predecessor failed to divest Mortgage; Appellant assumed t he risk of any lien that was not divested by the sale; and, under the terms of the Settlement Agreement, Appellant was barred from asserting any claims in relation to the sale, the property, the Cadbury APA, the Sale Order, and the Sale Amendment Ord er against the Liquidation Trustee, the Liquidation Trust, the Trust's assets, and the debtors' consolidated estates. Accordingly, the appeal of Chestnut Ridge is denied, and the January 20, 2010 Order of the Bankruptcy Court is affirmed. An Appropriate Order follows. Signed by Judge Nora Barry Fischer on 6/23/10.
