Filing 41 IT IS HEREBY ORDERED that 20 Defendants' Motion to Dismiss is GRANTED WITH PREJUDICE in part and GRANTED WITHOUT PREJUDICE in part, as more fully stated in the Order. IT IS FURTHER ORDERED that Plaintiff shall, if appropriate, file an Amended Complaint with respect to those claims that were dismissed without prejudice by April 21, 2011. Failure to do so will result in these claims being dismissed with prejudice. IT IS FURTHER ORDERED that summary judgment is GRANTED to Defendants on Pl aintiff's claims involving Defendant Watkins's alleged mishandling of Plaintiff's applications for hair exemptions, and Plaintiff's retaliation claims against Defendant Tedrow.
