MEMORANDUM ORDER indicating that, for reasons stated more fully within, all of Plaintiff's claims against Defendant Indiana Borough Police Department are dismissed, with prejudice, given Plaintiff's counsel's agreement to same during t he 4/26/12 Oral Argument; that Defendants Indiana Borough, Officer Michael Rhoades, Chief William Sutton and Officer Wesley Hite's argument relating to spoliation is denied, without prejudice, given Defense counsel's withdrawal of same dur ing the 4/26/12 Oral Argument; and that Defendants Indiana Borough, Officer Michael Rhoades, Chief William Sutton and Officer Wesley Hite's Motion 6 is denied without prejudice to the arguments raised therein, which this Court finds should be more properly raised at the close of discovery. Hence, Defendants Indiana Borough, Officer Michael Rhoades, Chief William Sutton and Officer Wesley Hite shall file an Answer to the Complaint on or before 5/29/12.
