Filing 68 MEMORANDUM OPINION indicating that, for the reasons stated more fully within, Defendants' Motions to Dismiss 41 , 44 , 46 are granted, in part, and denied, in part. Said Motions are granted to the extent that Defendants seek a transfer of this matter pursuant to 28 U.S.C. § 1404(a). Said Motions are denied, as moot, insofar as Defendants seek dismissal of ADPI's Amended Complaint for lack of personal jurisdiction or improper venue, and denied, without prejudice, to the extent they seek dismissal for failure to state a claim. An appropriate Order transferring this case to the United States District Court for the Eastern District of California follows. Signed by Judge Nora Barry Fischer on 4/14/14. (jg) |
