Filing 120 MEMORANDUM OPINION AND ORDER - upon consideration of the motion for summary judgment filed by Defendants (ECF No. 88 ) and the Report and Recommendation filed by the Magistrate Judge (ECF No. 115 ), and for the reasons set forth in the accompanying memorandum opinion, IT IS HEREBY ORDERED that the Magistrate Judge's Report and Recommendation is not adopted, and Defendants' motion for summary judgment is GRANTED in part and DENIED in part as follows: Count I of the third amended compl aint (ECF No. 41 ) is dismissed with prejudice. Defendant Mr. Patz is therefore dismissed as a party. The motion is denied in all other respects, and as more fully stated in said Memorandum Opinion and Order. Signed by Judge Kim R.
