MEMORANDUM OPINION AND ORDER denying 26 Motion for Summary Judgment. Plaintiff shall indemnify Defendants Jerry Ellis Construction and Jerry Ellis for $174,553.04 in damages that were awarded in the underlying action. It is further Ordered t hat the Clerk of Court shall enter judgment in favor of Defendants Jerry Ellis Construction, Jerry Ellis, and Gary Gadley, and against Plaintiff Cincinnati Insurance Company, and shall mark this case closed, and as more fully stated in said Memorandum Opinion and Order.
