August 4, 2015 Filing 22 Minute Entry for proceedings held before Judge Kim R. Gibson: An Initial Rule 16 Scheduling Conference was held with Attorney Lacey appearing in person and Attorney Hirnyk appearing telephonically on 7/31/2015. The Court noted that Attorney Hirnyk was appearing on behalf of Attorney Jody Burton, who was the attorney of record for Plaintiffs. The Court first reviewed the stipulation selecting ADR process, noting the parties had selected mediation but had not designated a mediator. Counsel explained that they were attempting to resolve the case prior to the start of discovery. The Court noted that counsel could utilize the services of Magistrate Judge Pesto to conduct mediation. Counsel explained that they would confer with their clients and inform the Court early next week regarding their willingness to participate in mediation with Judge Pesto. The Court explained that it would enter an order giving the parties a deadline of November 1, 2015, to complete mediation. The Court then reviewed the parties' proposed initial scheduling order. Counsel agreed that the dates in the proposed order were correct. The Court stated that it would enter the scheduling order on the docket and that counsel should review paragraph 8 of the order for the date and time of the post-discovery status conference.
