MEMORANDUM OPINION AND ORDER granting 13 Motion to Dismiss for Failure to State a Claim as follows: Plaintiff's claim against Defendant Bedford County is dismissed with prejudice. Plaintiff's claim against Defendant Fetter in Fetter 9;s official capacity as Bedford County's Prothonotary/Clerk of Courts is dismissed without prejudice. Plaintiff is granted leave to file on or before 2/12/2017, if at all, an amended complaint stating alternative claims against Defendant Fetter, and as more fully stated in said Memorandum Opinion and Order.
