Filing 36 MEMORANDUM AND ORDER re 32 Report and Recommendation; and re 27 Motion to Dismiss for Lack of Jurisdiction. The Court ADOPTS IN PART and REJECTS IN PART the magistrate judge's findings and recommendations. Accordingly, defendant Tropical M arine's motion to dismiss pursuant to Rule 12(b)(1) is GRANTED. Because the Court lacks subject matter jurisdiction to hear this controversy, the Court also dismisses the case against defendant Lucke even though he failed to file any motion to dismiss.
