Filing 123 ORDER RULING ON REPORT AND RECOMMENDATION 106 . The Court sustains Plaintiffs objections, overrules Defendants objections, declines to adopt the portion of the Report that recommends that Defendants Smith and Simss motion for summary judgment be granted, adopts the remainder of the Report, and incorporates it herein. Therefore, it is the judgment of this Court that Defendant Craigs motion for summary judgment is GRANTED and Defendants Hunt, Bittinger, Smith, and Simss mot ion for summary judgment is DENIED.Finally, on or preferably before Wednesday, August 17, 2016, counsel for the parties shall submit to the Court a joint proposed consent amended scheduling order.
