MEMORANDUM OPINION AND ORDER. "For the reasons stated above, Plains Capitals motion for summary judgment (Doc. No. 57)and the United States cross-motion for summary judgment (Doc. No. 60) are DENIED. Furthermore, the Court notes that the parties have stipulated to all the facts except one: whether the IRS authorized Boardwalk to pay the Plains Capital loan.
