The court grants the Amended Motion to Dismiss Under Rule 12(b)(2), (4), (5), (6), and Rule 9(b) and dismisses without prejudice Plaintiff's RICO claim for lack of standing. The court declines to exercise supplemental jurisdiction over Plaintiff's pendent state law claims for tortious interference with a contract and pros pective relations and dismisses them without prejudice to Plaintiff's right to bring the claims in state court.
