Filing 71 RECOMMENDATION REGARDING NON-PRISONER'S IFP STATUS ON APPEAL: It is recommended that the Court deny Sherrie R. Lowe's motion to proceed in forma pauperis on appeal 67 , and certify, pursuant to FED. R. APP. P. 24(a) and 28 U.S.C. § 1915(a)(3), that the appeal is not taken in good faith in light of this Court's 1/11/2016 order 64 accepting the findings, conclusions and recommendation of the Magistrate Judge 62 . See Howard v. King, 707 F.2d 215, 220 (5th Cir. 1983) (an appeal is not taken in good faith when it fails to present non-frivolous issues). (Ordered by Magistrate Judge Renee Harris Toliver on 2/23/2016) (mcrd) |
Filing 64 ORDER ACCEPTING THE 62 FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: The United States Magistrate Judge made findings, conclusions, and a recommendation in this case. Plaintiff filed objections, and the District J udge has made a de novo review of those portions of the proposed findings, conclusions, and recommendation to which objection was made. The objections are overruled and the Court ACCEPTS the Findings, Conclusions, and Recommendation of the United States Magistrate Judge. (Ordered by Judge Barbara M.G. Lynn on 1/11/2016) (bdb) |
Filing 33 ORDER: The United States Magistrate Judge made Findings, Conclusions, and a Recommendation in this case, among other things recommending dismissal if Plaintiffs did not amend. They have now done so. The issues raised in the 27 Findings, Conclusions and Recommendations are thus moot, at least for now. (Ordered by Judge Barbara M.G. Lynn on 6/3/2015) (twd) |
