Memorandum Opinion and Order: The court ORDERS that 11 respondent's motion to dismiss the petition be, and is hereby, granted and that the petition be, and is hereby, dismissed for failure to exhaust state court remedies as required by 28 U.S.C. § 2254(b) (1). For the reasons discussed herein, the court further ORDERS that a certificate of appealability be, and is hereby, denied, as petitioner has not demonstrated that he has exhausted his state court remedies or made a substantial showing of the denial of a constitutional right.
