June 9, 2017	Filing 34 OPINION AND ORDER ON REMAND: Petitioner's petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 is conditionally GRANTED as follows: (1) Petitioner's judgment of conviction and sentence for distribution of methadone resul ting in death, in violation of 21 U.S.C. § 841(b)(1)(C), entered by the district court for the Western District of Texas is VACATED; (2) The district court for the Western District of Texas shall enter judgment on the offense of distribution o f methadone, in violation of 21 U.S.C. § 841(a)(1), and resentence Petitioner within 90 days; (3) Respondent shall deliver Petitioner, who is currently confined at the federal prison camp in Bryan, Texas (FPC-Bryan), to the Western District of Texas for resentencing.
