Filing 16 Memorandum Opinion and Order. Based on the foregoing, the Court DENIES Rockwell's Petition for a Writ of Habeas Corpus. In accordance with Federal Rule of Appellate Procedure 22(b) and 28 U.S.C. § 2253(c), and after considering the record in this case, the Court denies Rockwell a certificate of appealability because he has failed to make a substantial showing of the denial of a constitutional right. See Miller-El, 537 U.S. at 338; Slack v. McDaniel, 529 U.S. 473, 48384 (2000); 28 U.S. C. § 2253(c)(2). If Rockwell files a notice of appeal, he may proceed in forma pauperis on appeal. 18 U.S.C. § 3006A(7). All relief not expressly granted is denied, and this case is DISMISSED with prejudice. Filing 8 Memorandum Opinion and Order: On January 12, 2015, this Court granted the motion of petitioner Kwame A. Rockwell for the appointment of counsel subject to the satisfaction of the filing-fee requirement. (ECF No. 3 ) On February 2, 2015, appointed c ounsel filed an application to proceed in forma pauperis ("IFP") on behalf of Rockwell. (ECF No. 5 ) On February 20, 2015, appointed counsel filed a motion to withdraw due to an unforeseen conflict of interest. (ECF No. 6 ) On April 20, 2 015, appointed counsel filed a motion to remain appointed because she had resolved the conflict of interest.
