Filing 28 ORDER AND OPINION granting 27 MOTION for Summary Judgment. To survive a motion for summary judgment in a Texas premises liability case, a plaintiff must provide evidence raising a genuine issue of material fact as to whether the Defendant had actua l or constructive knowledge of a dangerous condition which allegedly caused that plaintiff's injuries. Because the Plaintiffs in this case have not provided sufficient evidence to raise that genuine issue, the Court grants the Defendant's motion for summary judgment.(Signed by Judge Andrew S. Hanen) Parties notified.(bcampos, ) |
Filing 21 MEMORANDUM OPINION AND ORDER denying 6 Motion to Remand; denying 9 Motion for Leave to File; Plaintiff's Motion for Leave to File Amended Petition (Docket No. 9) to add Mr. Orozco as a party is hereby DENIED. As this Court has diversity jurisdiction over the remaining action between the Plaintiffs and Defendant Wal-Mart, Plaintiff's Motion to Remand (Docket No. 6) is hereby DENIED.(Signed by Judge Andrew S. Hanen) Parties notified.(bcampos, ) |
