Filing 9 REPORT AND RECOMMENDATION: that Plaintiff's civil rights claims brought against Judge Sage be dismissed with prejudice as frivolous pursuant to 28 U.S.C. § 1915(e). It is further recommended that Plaintiff's habeas corpus claims be dis missed without prejudice to filing an application for habeas corpus relief after he has exhausted his state court remedies.
