OPINION AND ORDER - For the reasons stated herein, Defendant's Motion for Summary Judgment is hereby GRANTED insofar as Defendant's motion is limited to damages pertaining to delivery delay. Plaintiffs potential recovery of damages caused b y or resulting from the alleged late delivery of the crane at issue in this case is LIMITED to $780,000.00. Defendant's Motion to Strike Plaintiffs Surreply is MOOT, as the Court did not rely on any of the contested authority in deciding Defendant's Motion for Summary Judgment.
