This copyright infringement case is before the court on Defendants' Joint Motion to Exclude the Reports and Testimony of Paul Arnold (ECF No. #152 ). Defendants argue that the court should exclude Arnold's reports and testimony because he is not qualified as an expert, he used improper methods to formulate his expert reports, and his reports contain improper legal conclusions. Defs.' Br. (ECF No. 153). Plaintiffs argue that Arnold's experience as a recording engineer and producer render him qualified to offer expert testimony and that his opinions would assist the jury in evaluating the similarity between their copyrighted work and allegedly infringing songs. After reviewing Arnold's deposition and reports, I conclude that - though possessed of specialized knowledge - Arnold's analysis in this case is limited to "listening the way an average person would" and thus not likely to assist the factfinder. Arnold Dep. (ECF No. 129-17, at 11). Accordingly, for the reasons outlined below (See Order for Specifics), the court GRANTS Defendants' Motion (ECF No. #152 ) and excludes Arnold's testimony and reports.
